Workers bills could run  into millions of dollars

Two senators yesterday introduced a bill that would make it possible to revoke, suspend, withhold, or deny a contractors license if they do not pay the health care bills of their non-immigrant temporary workers.

Senators B.J. Cruz and Dennis Rodriguez, Jr. introduced Bill 49 yesterday in response to reports from Guam Memorial Hospital Authority that it is owed $400,000 in unpaid bills for non-immigrant temporary workers.

Cruz said he is worried the problem will be exacerbated by the increase in temporary workers expected for the construction needed for the relocation of Marines from Okinawa to Guam.

œWith a dramatic increase in overseas workers, we can expect to see these unpaid bills go from $400,000 to perhaps millions of dollars, Cruz said in a release yesterday.

œThis is an unacceptable burden on our community and the local taxpayer, illustrating what I have been saying all along; that the right choke point for the buildup is the hospital, he added.

Bill 49 will include failure to pay bills to the hospital and other health agencies like the Department of Mental Health and Substance Abuse and the Department of Public Health and Social Services to the list of reasons a contractors license could be revoked, suspended or denied.

The bill will also require government agencies to provide billing documentation to the Guam Contractors Licensing Board.

The bill would add not paying the health care bills to several other causes a contractor can have their license revoked or suspended such as conviction of a felony or any misdemeanor involving moral turpitude, flagrant misrepresentation in advertising, abandoning a project without a reasonable or legal excuse, and failure to secure and maintain workers compensation insurance among other things.

Cruz said he is also looking at amending the H-2 certification requirements to force contractors to provide health insurance to their employees as another way to combat the issue of unpaid health care bills.
