BMV employee indicted, another arrested in driver’s license case

AN employee of the Department of Public Safetys  Bureau of Motor Vehicles has been indicted while another defendant was arrested by federal agents in connection with the unlawful production of a CNMI drivers license.

William A. Hocog, also known as Bill, was indicted on Monday, together with Mohammad Jahangir Miah; Tahira Dolores Miah; Hongmei Sun, also known as Hongmei; and Hui Qiang Yang, also known as Hui Chang.

Hocog has been arrested and released, while Hongmei was arrested on Friday, Variety was told.

In Superior Court, the jury trial for Derek Robert Duenas " charged with conspiracy and bribery in connection with CNMI drivers license case " has been scheduled for April 4, 2011.

Duenas co-defendant, Dong Hyen Kim, will be sentenced on April 25. He has pleaded guilty to one count of bribery.

Hocog, Mr. Miah, Mrs. Miah, Hongmei, and Hui Chang were charged with one count of conspiracy to unlawfully produce and transfer identification card and eight counts of unlawful production of identification document, according to the indictment filed by Assistant U.S. Attorney Kirk W. Schuler.

The conspiracy occurred from on or about April 16, 2010 to on or about June 18, 2010, according to the indictment.

Hongmei Sun and Hui Qiang Yan introduced foreign nationals as drivers license applicants to Mr. Miah and Mrs. Miah œin order for the applicants to obtain a drivers license unlawfully with the help ofHocog, the indictment said.

It added that the defendants produced and transferred at least three  licenses at the BMV office to three foreign nationals in exchange for money.

The applicants were required to pay between $230 and $400 œdirectly to defendants Hongmei Sun or Hui Qiang Yan in order to receive their drivers license, the indictment said.

The applicants could not speak English, the indictment said, adding that œthe three foreign national applicants had not satisfied the legal requirements to receive a drivers license.

Upon their conviction, the defendants should forfeit the $400 they received on or about April 16, 2010; $350 on or about May 14, 2010; and $210 on or about June 18, 2010, the prosecution said.

After the detention hearing yesterday, visiting Federal Judge Michael W. Mosmon ordered the release of Hongmei Sun upon posting a $25,000 unsecured bond.

She has denied the charges and is represented by court-appointed defense attorney Robert. T. Torres.

In his affidavit, Mark D. Yamanaka, U.S. Immigration and Customs Enforcements resident agent in charge of the Office of Homeland Security Investigation on Saipan, said a cooperating source met an Asian adult female, later identified as Hongmei Sun, at a restaurant in Chalan Piao on April 13, 2010, at about 3:04 p.m., in connection with securing a CNMI drivers license.

On April 16, 2010, Hongmei and the cooperating source œmet a known young Micronesian female in a white Toyota Corolla which was parked near a restaurant in Chalan Piao, the affidavit added.

The Micronesian female then drove Hongmei and the cooperating source to the BMV office, the affidavit added.

In the parking lot, the Micronesian female was left inside the vehicle, while Hongmei and the cooperating source went inside BMV, where a œMicronesian male adult at window number one took the application, the affidavit stated.

It added that the same œMicronesian male adult had the cooperating source pose for a CNMI drivers license photo, œand within 10 minutes the cooperating source was issued a CNMI drivers license.

Mr. Miah has been in detention since his arrest on Dec. 12. On the same day Mrs. Miah, his wife, was also arrested by federal agents but she was not detained since she agreed to cooperate with the authorities.

The court required Mrs. Miah to post a $5,000 unsecured bond and to surrender and not obtain any new passport or travel document.Her husband has denied the charges against him.
