Judiciary facing ‘payless paydays’

The judiciary of Guam may be facing payless paydays and because of this, Sen. Adolpho Palacios sent a letter to Governor Eddie Calvo urging him to provide the judiciary with the rest of their funding allotment for this fiscal years budget.

The judiciary has so far received less than 50 percent of its funding allotment and it is owed over $3 million for operations alone.

œThe judiciary has already implemented stringent austerity measures and, as we have previously warned, the continued failure to pay the judiciarys allotments on a timely basis puts our employees at risk for furloughs and payless paydays, said spokesperson for the courts, Maria Cenzon.

Palacios said after talks with court officials, he learned that they had not received the full amount of their funds, and he is concerned that if this trend continues as it has in previous years, œit could reach a point in which it may directly impact personnel and court operations, he wrote.  

Cenzon said that as of Dec. 22, the judiciary has only received $2,705,145.00 of their allotment of $5,780,346. This means they are still owed $3,075,201 for operations alone.  

She also noted that the judiciary is not receiving their percentage of revenues collected either.

Public Law mandates that the Judiciary receive its percentage of revenues collected each month from the Department of Administration. The law subjects the Director of DOA to legal action through a writ of mandamus for failure to perform this ministerial duty.

Chief Justice Philip Carbullido met with the governor earlier this week to express his concerns over the current economic conditions and articulate the needs of the judiciary and the necessity for sufficient funds to continue to provide the adequate level of services to the people of Guam, said Cenzon.

œWe are hopeful that we can find a mutually acceptable resolution but are also mindful of our fiduciary duty to our employees, she added.

Palacios in his letter, urged the governors œintervention and timely action, in providing the judiciary their full budgetary allotment.

Palacios stated in his letter that the judiciary is œcritical and shared his concern over the entity, œwhich has tremendous responsibility in the administration of justice within our community.

Palacios also reminded Calvo that the judiciary is a œthird and co-equal branch of our government.
