SOME of the public records told so far by the Tinian mayors office to comply with an Open Government Act request revealed unjustified buy orders.
On Oct. 17, 2010, for example, the mayors office bought 10 Tootsie Childs Play bags at Cost-U-Less in Tamuning, Guam using a credit cardSix days later, the mayors office bought beer and this time the receipt showed a note stating Softball Game.
Most of the receipts provided by mayors office did not state the purpose and intention of the bought items.
Robert Myers, the counsel of former Saipan and Northern Islands Municipal Council member Felipe Q. Atalig, who requested the documents from the Tinian mayors office, has questioned the Attorney Generals Office to provide his client the necessary information regarding the buy orders.
Myers wants to see public information and records regarding the receipts, including, but not limited to, explanation of what was bought and for what purpose, and whether the buys were for personal use at government expense.
Myers also requested the AGO to advise the mayors office to comply with the Open Government Act request immediately.
Incomplete
Myers, in his letter to Assistant Attorney General Craig Deitrich, said many of the requested documents were not made available for inspection.
On Dec. 7 and 8, Atalig sent an Open Government Act request to the Tinian mayors office and the Tinian municipal treasury.
On Dec. 30 and Jan. 3, 2011, the mayors office submitted some documents but not the travel vouchers and trip reports, contracts or agreements executed by the mayor, notices of personnel action, requests for personnel action and receipts issued by the mayors office.
Myers said the mayors office also failed to submit the correspondence or any written communication from the Office of the Public Auditor or of the AGO or any other law enforcement agency regarding the hiring of former Sen. Jose M. Dela Cruz, Tinian Mayor Ramon M. Dela Cruzs brother.
The municipal treasury office also failed to submit documents as requested by Atalig.
Myers said what the mayors office submitted were receipts of different buys and payments involving brake pads, two 6 ft. Christmas trees, roundtrip plane tickets, oranges and apples, Ryobi Backpack blower, drinks and meals, one sack of 20 lbs rice, gasoline, donuts and candies.
There were buy orders indicating Mayor Dela Cruz as the vendor, and signed by Allen M. Perez as acting Tinian municipal treasurer.
Some receipts showed that the transaction took place during weekends like the buy of drinks and meals at Shirleys Coffee Shop, payments to certain individuals and a plane ticket.
In an interview, Atalig said he believes the buys were made for personal purposes.
Theres no justification that the buys were for government use, he added.
One of the documents indicated that Mayor Dela Cruz signed the notification of personnel action dated Nov. 22, 2010 for Jose M. Dela Cruz.
The document showed that Jose M. Dela Cruz was designated as a senior advisor and would receive a biweekly salary of $1,538.46 or $40,000 per year. He would also be allowed to have eight hours of annual leave and four hours sick leave per pay period.
Atalig earlier said that the mayors brother was convicted in 2003 of a federal crime " conspiracy to commit wire fraud " and should not hold any government position.
