PROSECUTORS are seeking the death penalty on three of four defendants who allegedly plotted Staff Sergeant Nathan Paets murder last month"including his wife.

Michael Rudolph Rodriguez, 31; Corry A. Hawkins, 33; Jessica A. Austin, 23; and Paets 29-year-ancient wife, Michelle Paet, were indicted by the Clark County Grand Jury last month for murder, conspiracy to commit murder, and burglary with a deadly weapon.

Rodriguez and Hawkins are facing a fourth charge of possession of a firearm as an ex-felon.

Prosecutors will seek capital punishment on three defendants"Paets wife, Rodriguez and Hawkins.

But, it was not clear what penalty prosecutors would seek on Austin who allegedly helped to hide evidence in connection with Paets murder.

All four defendants pleaded not guilty on Tuesday and waived their right to a speedy trial.

The defendants will appear in court again today to set a date for trial.

All four are being held without bail.

According to police, Paets wife and Rodriguez, who were allefedly having an affair, confessed to plotting her husbands death as early as October 2010.

Paet, 28, was gunned down in Las Vegas, Nevada on Dec. 1 by a man œlying in wait as he was walking out his garage to head to work.

Paets wife sent coded text messages to Rodriguez minutes before her husbands murder to indicate precisely when to wait for her husband to step out the garage, police said.

Police believe either Rodriguez or Hawkins shot Paet.

Austin, who shared an apartment with Hawkins, allegedly lit a fire in her apartment and helped Hawkins and Rodriguez burn their clothing after the murder of Paet.

Rodriguez initially told authorities that he had an alibi for the night of the murder"an ex-porn star he was œhaving sex with at a nearby hotel.

But, when questioned by police, the woman denied Rodriguezs claim and confessed to police about the plot to murder Paet.

Paet, originally from Yona, joined the U.S. Air Force in 2002. He had been stationed in Las Vegas since 2007 and was an assistant non-commissioned officer-in-charge for the Strike Aircraft Maintenance Supply section of the 757th Aircraft Maintenance Squadron.

Paet left behind four children who are now in the custody of his family.
