BENSON John D. Dela Cruz who got paroled in 2009 after serving time for sexually abusing a minor was arrested Wednesday on a rape charge.
Superior Court Associate Judge Perry B. Inos ordered the arrest of 24-year-ancient Dela Cruz after Detective Simon Manacop filed an affidavit of probable cause.
Dela Cruz, a registered sex offender, is now being held on the charges of rape, and assault and battery.
Yesterday, Associate Judge Ramona V. Manglona raised to $50,000 cash the $25,000 bail earlier set by Inos.
Dela Cruz was remanded to the custody of the Department of Corrections after the hearing.
Assistant Attorney General Benjamin Petersburg represented the government while Assistant Public Defender Richard Miller was appointed by the court to represent Dela Cruz.
Court records showed that Dela Cruz was granted parole on Sept. 16, 2009. Dela Cruz was sentenced to six years imprisonment, all suspended except for four years, after he pleaded guilty to the sexual abuse of a minor in the second degree on Feb. 20, 2008.
In the new case against Dela Cruz, Manacop said police received a rape complaint on Tuesday, at about 9:51 a.m., at Kagman High School, where the 18-year-ancient victim and the mother were met by investigators.
Manacop said the rape incident occurred on the early morning of Oct. 16 within the Capital Hill area.
The victim told police she was picked up past midnight by Dela Cruz, together with another person, identified only as Jay.
The group drove to Garapan and bought liquor. While returning to Capital Hill, Dela Cruz forced the victim to drink liquor while inside the vehicle, police said.
The victim was raped by the Ancient Peoples Park, police added.
After raping her, police said Dela Cruz told Jay that it was his turn, but he declined.
The victim was dropped at her home at around 5 a.m., Saturday.
On Oct. 20, 2010, Detective Melissa Bauleong interviewed the victim at the departments Criminal Investigation Bureau.
The victim said she did not report the incident straight away because Dela Cruz œthreatened her not to tell anyone or he would harm her, Bauleong said.
Dela Cruz met the victim sometime in Sept. 2009.
The victims mother found out the relationship in Oct. 2009, and the victim broke off with Dela Cruz.
Dela Cruz and the victim remained friends from then on, Bauleong said.
Dela Cruz was identified by the victim through police mug shots.
